Original copy in Contract file <br />(permanent file) <br /> <br />r.nnTmunr.m <br />THIS CONTRACT, made and entered into this ? day of November, <br />1989, by and between May£ield Village, a Municipal Corporation of Cuyahoga <br />County, Ohio (hereinafter called the "Village") and Progressive Landscaping <br />Design (hereinafter called "Contractor"). <br />WITNESSETH: <br />WIiEREAS, the Contractor did on the 8th day of October, 1989, submit <br />a proposal to provide snowplowing for the driveways of the elderly residents <br />within the Village; and <br />WHEREAS, the proposal of October 8, 1989, for a rate o£ Ninety <br />? <br />Dollars ($90.00) per drive for the period beginning with the first snowfall o£ <br />1989 through the last snowfall in the Spring of 1990, was accepted by the <br />Village. <br />NOW, THF.REFORE, in consideration of the following mutual agreements <br />and covenants, it is unde=stood and agreed by and beGween the parties hereto <br />as follows: <br />1. The Contractor is hereby granted the Pranchise, license and <br />privilege within the territorial jurisdiction of the Village <br />and shall furnish all personnel, labor, equipment, trucks <br />and all other items necessary, to provide snowplowing ser- <br />vices for the elderly residents as designated by the Village. <br />As of the date of this Contract, the Village has taken all <br />appropriate action necessary to lawfully grant such franchise <br />to Contractor. <br />2. The Contract shall be for a period beginning with the £irst <br />snowfall of 1989 through the last snow£all in the Spring of <br />1990, £or a rate of Ninety Dollars ($90.00) per drive for <br />snowplowing for the elderly residents on those days that <br />there is an accumulation in excess of two (2) inches: The <br />Page 1 of 3
