ORDINANCE N0. 86-,5 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />AN ORDINANCE ESTABLISHING A POLICY FOR <br />THE PAYMENT OF OVERTIME COMPENSATION TO <br />EMPLOYEES OF THE MUNICIPALITY AND <br />DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1; The provisions of this Ordinance shall be <br />effective with the effective date of this Ordinance. <br />Section 2 Except for those employees not covered by the <br />overtime provisions of the Fair Labor Standards Act, or the <br />regulations promulgated pursuant thereto, all full-time employees of <br />the municipality shall be compensated for overtime as follows: <br />A. For members of the safety forces, at the rate of <br />one and one-half (1-1/2) times the employee's regular hourly <br />rate for that time actually worked in excess of the maximum <br />hours permitted for that employee's work period as those <br />maximum hours are established by the Fair Labor Standards <br />Act or the regulations promulgated pursuant thereto. <br />B. For all other employees at the rate of one and one-half <br />(1-1/2) times the employee's regular hourly rate for that time <br />actually worked in excess of forty (40) hours during a seven <br />(7) day work week. <br />Section 3. Employees shall, at their election, be able to <br />accrue compensatory time at one and one-half (1-1/2) the number of <br />overtime hours worked, in accordance with the provisions of Section 2 <br />hereinabove, in lieu of cash payment provided, however, that no <br />employee shall be allowed to accrue compensatory time in excess of <br />that permitted by the Fair Labor Standards Act or the regulations <br />promulgated pursuant thereto. In the event an employee works overtime <br />when his "compensatory time bank" is at the maximum permitted by this <br />Section then such employee shall be paid cash for all overtime worked. <br />Section 4. All prior ordinances inconsistent with this <br />ordinance in whole or in part are repealed to the extent necessary to <br />avoid conflict with this ordinance. <br />Section 5. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code.. <br />Section 6. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />
