ORDINANCE N0. 86-7 (AS AMENDED) <br />INTRODUCED BY: Councilmen David Petschauer, George F. Goley <br />and Santo Basile <br />AN ORDINANCE ENACTING SECTION 521.10 OF <br />THE CODIFIED ORDINANCES OF MAYFIELD <br />VILLAGE, OH I0, PERTAINING TO CLEAN <br />INDOOR AIR AND REPEALING ALL ORDINANCES <br />INCONSISTENT HEREWITH. <br />WHEREAS, the Council of Mayfield Village, Ohio finds that <br />tobacco smoke is a major contributor to indoor air pollution; and <br />WHEREAS, the Council further finds that smoking in enclosed <br />areas is detrimental to the health, welfare, comfort and environment <br />of nonsmokers and is particularly harmful to nonsmokers with allergies <br />or with cardiovascular or respiratory disease; and <br />WHEREAS, the Council further finds that smoking in certain <br />enclosed areas is a public nuisance and a cause of material annoyance, <br />discomfort and physical irritation to nonsmokers; and <br />WHEREAS, the Council further finds that nonsmokers who <br />suffer ill effects of breathing second-hand smoke may experience a <br />loss of job productivity and may be prevented from using commercial <br />establishments and other public places; and <br />WHEREAS, the Council further finds that nonsmokers presently <br />have no adequate means to protect themselves from the damage inflicted <br />upon them when they involuntary inhale smoke emitted from cigarettes, <br />cigars, pipes and other smoking. materials; and <br />WHEREAS, it is not the intent of the Council to prohibit <br />smoking or the sale of tobacco products, but rather to affirm the <br />right of nonsmokers to breath clean air; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD V ILLAGE, OHIO, THAT: <br />Section 1. Section 521.10 of the Codified Ordinances of <br />Mayfield Village; Ohio is hereby enacted to read as follows: <br />Chapter 521 <br />Health, Safety and Sanitation <br />* ~ ~ <br />521.10 Clean Indoor Air. <br />(a) Citation, This Section may be cited as the Mayfield <br />Village Clean Indoor Air Ordinance. <br />(b) Findings and Purpose.
