M.V. ORDINANCE N0. 86° 22 <br />Page -2- <br />(3) The authorized use and occupancy of the dwelling <br />structure or unit. <br />(4) The listing of all known violations of this <br />Building Code existing at the time of such <br />inspection. <br />(d) The Certificate of Housing Inspection shall be valid for <br />a period of one hundred twenty (120) days from the date of the <br />inspection required herein. <br />1379.03 Fee <br />The fee for a Certificate of Housing Inspection shall be <br />Twenty Five Dollars ($25.00). <br />1379.04 Compliance with Certificate of Housing Inspection <br />No person, agent, firm or corporation shall rent or sell, by <br />land contract or otherwise, any interest in any dwelling <br />structure or unit without furnishing the prospective tenant or <br />buyer, prior to such rental or sale, a current Certificate of <br />Housing Inspection. When an escrow has been established, there <br />shall be deposited in escrow, prior to delivery of possession or <br />transfer of title, a statement from the prospective tenant or <br />buyer acknowledging the receipt of the Certificate of Housing <br />Inspection. There shall furthermore be required a statement <br />signed by the owner and prospective tenant or buyer indicating <br />which of the parties shall accept responsibility for correcting <br />any violations of the Building Code listed on the Certificate of <br />Housing Inspection. <br />1379.05 Escrow Agent; Disbursal of Funds without Statement <br />Prohibited <br />No person, firm or corporation acting in the capacity of an <br />escrow agent in any real estate transaction involving the sale of <br />a dwelling located within the municipality shall disburse any <br />funds unless there has been complete compliance with the <br />provisions of this Chapter. <br />1379.05 Limitation of Liability <br />The Certificate of Housing Inspection required herein does <br />not warrant or guarantee the condition of any dwelling structure <br />or unit located within the municipality nor does the same act as <br />a warranty or guarantee of the condition of the premises by the <br />Building Commissioner or any of his duly authorized agents. <br />1379.99 Penalty <br />
