M.V. ORDINANCE N0. 86- 24 <br />Page -5- <br />F. The Municipality hereby agrees that the County shall be <br />and is hereby saved harmless from any and all damages or <br />claims thereof arising from or growing out of the <br />certification or obligations made or agreed to in <br />Sections 6A, 7A, B, C, and D hereinabove. <br />Section 8. Mayfield Village acknowledges that if the <br />County is formally requested by Municipal Resolution to include the <br />construction of sanitary sewers, water lines, area sewers, (drainage <br />of areas surrounding the improvement), sidewalks, alternate bid items, <br />or other items in the improvement that are in addition to those now <br />existing, and not provided for elsewhere in this Ordinance, the County <br />will do so, provided that this construction meets with the approval of <br />the County and the Municipality involved in this improvement; and that <br />the Municipality agrees to pay the non-federal costs of said <br />additional construction and the cost of engineering. <br />Section 9. Mayfield Village further acknowledges that for <br />matters relating to this improvement the agent for the County and <br />liason officer on the matter contained herein shall be the County <br />Engineer of Cuyahoga County, Ohio and/or such members of his staff as <br />he may designate. <br />Section 10. The Mayor is hereby authorized and directed <br />to enter into such agreements with Cuyahoga County as are necessary tc <br />complete the planning and construction of the afore-described improve- <br />ment. <br />Section 11. The Mayor is hereby further authorized and <br />directed to make application to the Cuyahoga County Board of <br />Commissioners for approval to use County Motor Vehicle $5.00 License <br />Tax Funds for the aforesaid improvement. <br />Section 12. That the Council finds and determines that <br />all formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 13. This Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the .reason that the actions authorized herein are necessary to <br />expedite highway improvements that will promote highway safety. It <br />shall therefore take effect immediately upon passage by the affirma- <br />tive vote of not less than four (4) members elected to Council and <br /> <br />
