The Municipality hereby agrees that the County shall be and is hereby saved harmless from any and all damages or claims thereof arising from or growing out of the certification or obligations made or agreed to in Sections 6A, 7A, B, C, and D hereinabove. Section 8. Mayfield Village acknowledges that if the County is formally requested by Municipal Resolution to include the construction of sanitary sewers, water lines, area sewers, (drainage of areas surrounding the improvement), sidewalks, alternate bid items, or other items in the improvement that are in addition to those now existing, and not provided for elsewhere in this Ordinance, the County will do so, provided that this construction meets with the approval of the County and the Municipality involved in this improvement; and that the Municipality agrees to pay the non-federal costs of said additional construction and the cost of engineering. Section 9. Mayfield Village further acknowledges that for matters relating to this improvement the agent for the County and liason officer on the matter contained herein shall be the County Engineer of Cuyahoga County, Ohio and/or such members of his staff as he may designate. Section 10. The Mayor is hereby authorized and directed to enter into such agreements with Cuyahoga County as are necessary tc complete the planning and construction of the afore-described improve- ment. Section 11. The Mayor is hereby further authorized and directed to make application to the Cuyahoga County Board of Commissioners for approval to use County Motor Vehicle $5.00 License Tax Funds for the aforesaid improvement. Section 12. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 13. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village for the .reason that the actions authorized herein are necessary to expedite highway improvements that will promote highway safety.
