ORDINANCE. NO. 86-25 INTRODUCED BY: Mayor Fred N. Carmen AN ORDINANCE ENACTING CHAPTER 1519 AND REPEALING SECTIONS 549.10 AND 549.11 OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, PERTAINING TO FIREWORKS AND DECLARING AN EMERGENCY. WHEREAS, the Ohio General Assembly enacted Amended Senate Bill 61, effective May 30, 1986, revising Ohio Revised Code Chapter 3743 pertaining to fireworks; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio, are desirous of amending the Codified Ordinances of the Municipality to comply with the aforementioned legislation; now, therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD V ILLAGE, OHIO, THAT: Section 1. There is hereby enacted Chapter 1519 of the Codified Ordinances of Mayfield Village, Ohio, said Chapter being attached hereto in its entirety and incorporated herein as if fully rewritten. Section 2. Sections 1519.02 and 1519.03 of Chapter 1519 shall be effective December 1, 1986, on which date Section 549.11 of the Codified Ordinances of Mayfield Village, Ohio, shall be repealed in its entirety, Section 3. Section 1519.05(8) of Chapter 1519 shall be effective January 1, 1987. Section 4. Sections 1519.01, 1519.04 and 1519.05(a) to (f) of Chapter 1519 shall be in effect and Section 549.10 of the Codified Ordinances of Mayfield Village, Ohio, shall be repealed on the effective date of this Ordinance. Section 5. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 6. This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village for the reason that the actions taken herein are necessary to protect residents of the municipality from injury due to elicit fireworks.
