ORDINANCE N0. 86- 28 <br />INTRODUCED BY: Councilman Lawrence J. Flynn <br />r <br />AN ORDINANCE REPEALING ORDINANCE N0. 86-21 <br />PERTAINING TO THE HIRING OF A PROFESSIONAL <br />PLANNING AND ZONING CONSULTANT FOR THE ZONING OF <br />CERTAIN PROPERTY LOCATED WITHIN THE MUNICIPALITY <br />AND FURTHERMORE DECLARING A MORATORIUM ON ANY <br />CONSTRUCTION WITHIN THE AFFECTED AREA, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, on September <br />15, 1986, enacted Ordinance No. 86-21; and <br />WHEREAS, Ordinance No. 86-21 authorized the Mayor to invite <br />bids from responsible professional planning and zoning consultants to <br />prepare a thorough and complete study of certain property located <br />within the municipality, the description of said property having been <br />set forth in Ordinance No. 86-18, for the purpose of preparing a <br />thorough and complete study of the said property to determine the <br />proper zoning of same; and <br />WHEREAS, Ordinance No. 86-21 furthermore declared that the <br />municipality shall not accept any plan for the development of the <br />subject property nor shall any permits issue for the construction of <br />any improvements thereon during the proceedings established in <br />Ordinance No. 86-18; and <br />WHEREAS, the aforesaid provision of Ordinance No. 86-21 <br />established a moratorium on any building within the affected area <br />bounded by Interstate 271 on the West, S.O.M. Center Road on the East, <br />Highland Road on the South and White Road on the North, less <br />approximately ninety (90) acres of land owned by the Allen-Bradley <br />Company for which plans for construction have already been submitted <br />to the municipality; and <br />WHEREAS, the Council has reconsidered its position and now <br />wishes to lift the moratorium on the affected area; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Ordinance No. 86-21, enacted by the Council of <br />Mayfield Village, Ohio, on September 15, 1986, is hereby repealed in <br />its entirety. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />
