Carmen <br />AN ORDINANCE ENACTING CHAPTER 1375 OF THE CODIFIED <br />ORDINANCES OF MAYFIELD VILLAGE, OHIO, PERTAINING <br />TO THE PREVENTION OF FLOOD DAMAGE BY ADOPTING <br />MINIMUM FLOODPLAIN MANAGEMENT REQUIREMENTS IN <br />ORDER TO MAINTAIN ELIGIBILITY IN THE NATIONAL <br />FLOOD INSURANCE PROGRAM, REPEALING EXISTING <br />CHAPTER 1375 AND P,LL ORDINANCES INCONSISTENT <br />HEREWITH AND DECLARING AN EMERGENCY. <br />WHEREAS, Article XVIII, Section 3, of the Ohio Constitution <br />grants municipalities the legal authority to adopt land use and <br />control measures for promoting the health, safety and general welfare <br />of its residents; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGEo OHIO, THAT: <br />Section l. There is hereby enacted Chapter 1375 of the <br />Codified Ordinances of [iayfield Village, Ohio, which shall read as <br />followsa <br />Chapter 1375 <br />Flood Damage Prevention <br />1375.01 Factual Basis. <br />(A) The flood hazard areas of Mayfield Village are subject <br />to periodic inundation which may result in loss of life and <br />property, health and safety hazards, disruption of commerce and <br />governmental services, extraordinary public expenditures for <br />flood protection adn relief, and impairment of the tax base, all <br />of which adversely affect the public health, safety, anc3 general <br />welfare. <br />(B) These flood losses are caused by the cumulative effect <br />of obstructions in areas of special flood hazards which increase <br />flood heights and velocities and, when inadequately anchored, <br />damage uses in other areas. Uses that are inadequately flood- <br />proofed, elevated or otherwise protected from flood damage also <br />contribute to the flood loss. <br />1375.02 Statement of Purpose. <br />It is the purpose of this ordinance to promote the public <br />health, safety and general welfare, and to minimize public and
