ORDINANCE N0. 87-7 <br />Page -16- <br />below base flood elevation provided that the enclosed <br />areas are designed to automatically equalize hydrostatic <br />flood forces on exterior walls by allowing for the entry <br />and exit of floodwaters. Specific design criteria are <br />found in the National Flood Insurance Program Rules and <br />Regulations. <br />(C) Floodways <br />A floodway is the channel of a river or other water- <br />course and the adjacent land areas that must be reserved <br />in order to discharge the base flood without cumulatively <br />increasing the water surface elevation more than one foot. <br />The floodway is an extremely hazardous area due to the <br />velocity of flood waters which carry debris, potential <br />projectiles, and erosion potential. The Flobd Insurance <br />Rate Map (or Flood Hazard Boundary Map) does not designate <br />a floodway. However, floodways may be delineated in other <br />available sources of flood information as specified in <br />Section 1375.14(B). The following provisions apply within <br />all delineated floodway areas: <br />(1) Prohibit encroachments, including fillo new <br />construction, substantial improvements, and other <br />development unless a technical evaluation <br />demonstrates that encroachments shall not result <br />in any increase in flood levels during the <br />occurrence of the base flood discharge. <br />(2) If subsection (1) hereinabove is satisfied, all <br />new construction and substantial improvements shall <br />comply with all applicable flood hazard reduction <br />provisions of Chapter 1375,16. <br />1375.99 Penalty. <br />Violation of the provisions of this Chapter or failure to <br />comply with any of its requirements shall constitue a misdemeanor <br />of the first degreee Any person who violates this Chapter or <br />fails to comply with any of its requirements (including <br />violations of conditions of and safeguards established in <br />connection with conditions) shall upon conviction thereof be <br />fined or imprisoned as provided by the laws of Mayfield Village. <br />Each day such violation continues shall be considered a separate <br />offense. Nothing herein contained shall prevent Mayfield Village <br />from taking such other lawful action as is necessary to prevent <br />or remedy any violations.
