ORDINANCE N0. 87- 12 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />AN ORDINANCE ENACTING SECTION 133.04 OF THE <br />CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, <br />ADOPTING A PROCEDURE AUTHORIZED UNDER OHIO REt7ISED <br />CODE 3929.86 TO ENABLE THE MUNICIPALITY TO RECEIVE <br />INSURANCE PROCEEDS AS SECURITY FOR THE REPAIR OR <br />REMOVAL OF FIRE DAMAGED STRUCTURES AND DECLARING <br />AN EMERG ENCY . <br />WHEREAS, Section 3929.86 of the Ohio Revised Code authorizes <br />municipalities to receive funds from insurance companies doing <br />business in the State as security for the repair, removal or securing <br />of fire damaged structures; and <br />WHEREAS, Section 3929.86 of the Ohio Revised Code requires <br />municipalities to adopt an ordinance, resolution or regulation <br />authorizing the implementation of such procedure and the filing of a <br />certified copy of the enactment with the State Superintendent of <br />Insurance; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF NiAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 133.04 of the Codified Ordinances of <br />Mayfield Village, Ohio, is hereby enacted to read as follows: <br />Chapter 133 <br />Department of Finance <br />* * ?r <br />133.04 Fire Damaged Structure; Removal or Repair Securing Fund <br />The Municipality hereby authorizes the procedure described <br />in Section 3929.86(c) and (d) to be implemented whereby no <br />insurance company doing business in the State shall pay a <br />claim of a named insured for fire damage to a structure located <br />within this municipality unless there has been full compliance <br />with the applicable provisions of Section 3929.86 of the Ohio <br />Revised Code. The Director of Finance is hereby designated <br />as the officer authorized to carry out the duties of Section <br />3929.86 of the Ohio Revised Code. The Clerk of Council shall <br />file a certified copy of this Ordinance vaith the State <br />Superintendent of Insurance. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121e22 of the Ohio Revised Code.
