D w- MAYFIELD VILLAGE <br />@ <br />MAy 2 9 1987 <br />/WA yOR <br />MA??oL? 10FpjcE <br />You have asked for an explanation of Ordinance 87-12 which authorizes <br />the Village to establish the procedure described in Section 3929.86(c) <br />and (d) of the Ohio Revised Code pertaining to fire damaged <br />structures. <br />Ohio Revised Code Section 3929086 provides assistance to munici- <br />palities in recovering the costs of removing, repairing, or securing <br />unsafe structures by specifying that no insurance company doing <br />business in the State shall pay a claim for fire damage to a structure <br />located within a municipal corporation where the loss agreed to <br />exceeds Five Thousand Dollars ($5,000,00) unless: <br />(a) The County Treasurer certifies that there are no <br />outstanding costs incurred by the municipality for the <br />removal, repair, or securing of the structure which have. <br />been certified to the County Auditor. If the County Treasurer <br />cannot make that certification then the insurance company <br />is required to transfer an amount from the insurance proceeds <br />to the County Treasurer to cover such costs on behalf of the <br />municipality. <br />(b) The insurance company transfers to a designated officer <br />of the municipality a percentage of the insurance proceeds as <br />security for the present costs of removing, repairing, or <br />securing the structure if the agreed loss equals or exceeds <br />sixty percent (60%) of the aggregate limits of liability on <br />all fire policies covering the structure.
