RESOLUTION N0. 87- 26 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION ACCEPTING AN EASEMENT FROM THE <br />HAYFIELD BOARD OF EDUCATION FOR THE INSTALLATION <br />AND MAINTENANCE OF A TRAFFIC SIGNAL DEVICE AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Mayfield Board of Education has recently <br />authorized the grant of an easement to Mayfield Village for the <br />installation and maintenance of a traffic signal device; and <br />WHEREAS, the municipality is desirous of accepting said <br />easement for the purposes therein mentioned; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. <br />of easement from the <br />and maintenance of a <br />by the said Board of <br />hereto, marked Exhib <br />rewritten. <br />Mayfield Village does hereby accept the grant <br />Mayfield Board of Education for the installation <br />traffic signal device on certain property owned <br />Education, a copy of said easement being attached <br />it "A" and incorporated herein as if fully <br />Section 2. The Mayor and President of Council are hereby <br />authorized and directed to endorse the acceptance of the said easement <br />as provided therein. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the easement accepted herein is necessary to install a <br />device that will enhance the ability of the municipality to effec- <br />tively maintain traffic control on a major thoroughfare. It shall <br />therefore take effect immediately upon passage by the affirmative vote <br />of not less than four (4) members elected to Council and approval by <br />
