~1 ~ Parcel 3R PPN831-31-36 i' I. i EASEMENT FOR INSTALLATION AND MAINTENANCE OF TRAFFIC SIGNAL DEVICE This indenture made and entered into by and between The Mayfield Board of Education, hereinafter referred to as Grantor, and the Village of Mayfield a municipal corporation, hereinafter referred to as Village. WITNESSETH: That in and for consideration of One Dollar ($1.00) and other good and valuable considerations to it in hand paid by the Village of Mayfield, receipt whereof is hereby acknowledge d, 'Grantor does hereby give and grant in perpetuity to said Village of Mayfield the right, privilege and authority to construct, reconstruct, repair, maintain and operate a traffic signal device, together with appurtenances thereto, in, under, upon, over and through the property of Grantor described as follows, to wit: Situated in the Village of Mayfield, County of Cuyahoga and State of Ohio and known as being part of Original Mayfield Township Lot No. 20, Tract 2 and further bounded and described as follows: Beginning at a point in the centerline of Wilson Mills Road (80 feet wide), said point being North 88°47'55" West, 473.70 feet measured along said centerline of Wilson Mills Road from its intersection with the centerline of Miner Road (60 feet wide): Thence South 1°12'05" West, 40.00 feet to a point and the principal place of beginning; Thence continuing South 1012'05" West, 50.00 feet to a point; Thence North 88°47'55" West, 24.00 feet to a point;' Thence North 1012'05" East, 50.00 feet to a point; Thence South 88047'55" East, 24.00 feet to the principal place of beginning containing 0.0275 acres of land, be the same, more or less but subject all legal highways. The Village agrees to exercise all due and proper care of Grantor's property during the installation of said traffic signal device, and further agrees to take all reasonable steps necessary to return said real estate to the condition in which it was prior to the time any work is begun. Grantor agrees that, at all times, the Village shall have the right of access to said easement property for the purposes of operation and maintaining said traffic signal device and to this end Grantor will keep said easement free and clear of any and all encumbrances so as to afford access to said traffic signal device at all times. This agreement and all of the terms, conditions, rights and obliga- .' tions herein contained shall inure to, and be binding upon the parties hereto, their successors, lessees and assigns;. and it is distinctly agreed that neither party shall assign its rights under this agreement without the written consent of both parties first had and ohtained. ~n~~~~
