~1 ~ <br />Parcel 3R <br />PPN831-31-36 <br />i' <br />I. <br />i <br />EASEMENT FOR <br />INSTALLATION AND MAINTENANCE <br />OF <br />TRAFFIC SIGNAL DEVICE <br />This indenture made and entered into by and between The Mayfield <br />Board of Education, hereinafter referred to as Grantor, and the Village <br />of Mayfield a municipal corporation, hereinafter referred to as Village. <br />WITNESSETH: <br />That in and for consideration of One Dollar ($1.00) and other good <br />and valuable considerations to it in hand paid by the Village of Mayfield, <br />receipt whereof is hereby acknowledge d, 'Grantor does hereby give and <br />grant in perpetuity to said Village of Mayfield the right, privilege and <br />authority to construct, reconstruct, repair, maintain and operate a traffic <br />signal device, together with appurtenances thereto, in, under, upon, over <br />and through the property of Grantor described as follows, to wit: <br />Situated in the Village of Mayfield, County of Cuyahoga and State <br />of Ohio and known as being part of Original Mayfield Township Lot No. 20, <br />Tract 2 and further bounded and described as follows: <br />Beginning at a point in the centerline of Wilson Mills Road (80 <br />feet wide), said point being North 88°47'55" West, 473.70 feet measured <br />along said centerline of Wilson Mills Road from its intersection with the <br />centerline of Miner Road (60 feet wide): <br />Thence South 1°12'05" West, 40.00 feet to a point and the principal <br />place of beginning; <br />Thence continuing South 1012'05" West, 50.00 feet to a point; <br />Thence North 88°47'55" West, 24.00 feet to a point;' <br />Thence North 1012'05" East, 50.00 feet to a point; <br />Thence South 88047'55" East, 24.00 feet to the principal place of <br />beginning containing 0.0275 acres of land, be the same, more or less but <br />subject all legal highways. <br />The Village agrees to exercise all due and proper care of Grantor's <br />property during the installation of said traffic signal device, and <br />further agrees to take all reasonable steps necessary to return said real <br />estate to the condition in which it was prior to the time any work is <br />begun. <br />Grantor agrees that, at all times, the Village shall have the right <br />of access to said easement property for the purposes of operation and <br />maintaining said traffic signal device and to this end Grantor will keep <br />said easement free and clear of any and all encumbrances so as to afford <br />access to said traffic signal device at all times. <br />This agreement and all of the terms, conditions, rights and obliga- <br />.' tions herein contained shall inure to, and be binding upon the parties <br />hereto, their successors, lessees and assigns;. and it is distinctly <br />agreed that neither party shall assign its rights under this agreement <br />without the written consent of both parties first had and ohtained. <br />~n~~~~ <br />
