ORDINANCE N0. 87-14 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />AN ORDINANCE ENACTING CHAPTER 701 AND SECTION <br />701.01 OF THE CODIFIED ORDINANCES OF MAYFIELD <br />V ILLAGE, OH IO, PROH IB ITING THE OPERATION OF <br />BUSINESSES CONDUCTED LARGELY OUT OF DOORS BETWEEN <br />THE HOURS OF 11:00 P.M. AND 6:00 A.M., REPEALING <br />ALL ORDINANCES INCONSISTENT HEREWITH AND DECLARING <br />AN EMERG ENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, finds that <br />the rest and peace of the residents of the municipality during the <br />quiet hours of 11:00 P.M. to 6:00 A.M. is important; and <br />WHEREAS, there has been in the municipality and in adjacent <br />municipalities a proliferation of businesses conducted largely out of <br />doors open on a twenty four (24) hour basis; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATo <br />Section 1. There is hereby enacted Chapter 701 and <br />Section 701.01 of the Codified Ordinances of Mayfield Village, Ohio, <br />which shall read as followso <br />Chapter 701 <br />Businesses Generally <br />701.01 Prohibited Hours of Operation. <br />(a) No business operation within the Village whose business <br />is conducted largely out of doors with lights, bells and <br />exposure to transient pass through traffic suggesting <br />police surveillance during the night season shall be operated <br />between the hours of 11:00 P.M. and 6:00 A.M. Any business <br />in actual operation on the effective date of this ordinance <br />and conducting activity prohibited by this ordinance may <br />continue but not increase such activity and once such <br />activity is c3iscontinued it shall not be resumed. <br />(b) The Building Commissioner shall have the authority <br />to enforce this Section and any relief from enforcement of <br />same shall be made in the same manner as a request for relief <br />unc7er the Charter, Planning & Zoning Code or the Building Code. <br />(c) Whoever violates any provision of this Section shall <br />be guilty of a misdemeanor of the third degree and shall be <br />fined not more than Five Hundred Dollars ($500.00) nor sentenced <br />to more than sixty (60) days imprisonment, or both.
