**REPEALED BY ORD. 87-41 enacted 11/16/87** <br />ORDINANCE N0. 87-25 <br />INTRODUCED BYe Councilma:n David Petschauer <br />AN ORDINANCE ENACTING CHAPTER 701 OF THE CODIFIED <br />ORDINANCES OF MAYFIELD VILLAGE, OHIO, PERTAINING <br />TO COMMERCIAL ESTABLISHMENT WASTE CONTAINERS, <br />REPEALING ALL ORDINANCES INCONSISTENT HEREWITH AND <br />DECLARING AN EMERGENCYe <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. There is hereby enacted Chapter 701 of the <br />Codified Ordinances of Mayfield Village, Ohio, which shall read as <br />follows: <br />Chapter 701 <br />Commercial Establishment Waste Containers <br />701.01 Enclosed Structures Required. <br />Every person, firm, or corporation who operates a <br />commercial enterprise involving the use of containers <br />for the storage of garbage, rubbish, or other waste <br />materials, which containers are stored outdoors, shall <br />provide an enclosed masonry structure of split-face <br />block or face-brick within which the containers shall be <br />stored. The structure shall be constructed so as to allow <br />sufficient ventilation to prevent the accumulation of <br />offensive odors and to allow sufficient ease of access to <br />_ permit entry and to permit cleaning thereof. <br />701.02 Building Permit Required. <br />Every person, firm or corporation required by this <br />Chapter to erect an enclosed structure for refuse containers <br />shall obtain a building permit therefor from the Building <br />Commissioner and shall submit such plans and specifications <br />to the Building Commissioner at the time of application as <br />will permit the Building Commissioner to pass upon the <br />adequacy of the structure for the proposed use. <br />701.03 Existing Commercial Establishments. <br />Every person, firm or corporation operating a commercial <br />enterprise subject to the requirements of Section 701°O1 <br />hereinabove existing as of the date of enactment of this <br />Ordinance shall comply with the provisions of this Ordinance <br />within ninety (90) days following its effective date. <br />701.99 Penalty. <br />Whoever violates any of the provisions of this Chapter <br />is guilty of a minor misdemeanor and shall be fined not more <br />than One Hundred Dollars ($100.00) for each offense. A
