I <br />ORDINANCE N0. 87- 30 <br />INTRODUCED BY: Nayor Carmen & Council as a Whole <br />AN ORDINANCE AMENDING SECTION 1309.18 OF THE <br />CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, SO <br />AS TO ESTABLISH A SCHEDULE FOR LANDSCAPING OF <br />RESIDENTIAL PREMISES, REPEALING ALL ORDINANCES <br />INCONSISTENT HEREWITH MID DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Sect,ion 1. Section 1309.18 of the Codif ied Ordinances of <br />Mayfield Village, Ohio, is hereby amended as follows: (Deleted <br />material appears like +_hls and neaa material appears like THIS) <br />Chapter 1309 <br />Permits and Fees; Penalty <br /> <br />1309.18 Occupancy of Residential Suilding Before <br />Completion Prohibited; LANDSCAPING REQUIRED. <br />(a) No person, whether ovaner, tenant, or otherwise, shall <br />move into, occupy or reside in any single dwelling or private <br />residence, or any two-family dwelling or residence, or any <br />tenement building in the Municipality which does not contain <br />complete sanitary, heating, and plumbing f acilities installed <br />in accordance with the provisions of this Building Code or <br />which has not been completed in accordance with the provisions <br />of this Building Code and in accordance with the terms of a <br />builcling permit duly issued by the Building Commissioner. <br />(b) I F A PERSON, WH ETH ER OWNER, TENAN T, OR OTH ERW IS E, <br />DESIRES TO M0VE INTO, OCCUPY OR RESIDE IN ANY SINGLE DWELLING <br />OR PRIVATE RESIDENCE, OR ANY TWO-FAMILY DWELLING OR RESIDENCE, <br />PRIOR TO THE INSTALLATION OF LANDSCAPING ON THE PREMISES THEN <br />BEFORE SUCH PERSON OCCUPIES OR RESIDES IN SUCH PREMISES THE <br />PERSON SHP,LL CERTIFYo IN WRITING, ON A FORM TO BE APPROVED <br />BY THE BUILDING COMMISSIONER, THAT SUCH PERSON SHALL BE <br />RESPONSIBLE FOR COMPLETING THE LANDSCAPING ON THE PREMISES, <br />INCLUDING, BUT NOT LIMITED T0, THE FINAL GRADE P,ND SEEDING, <br />IN ACCORDANCE WITH THE APPROVED FINAL GRADE PLAN, PRIOR TO <br />THE END OF THE GROWING SEASON NEXT FOLLOWING THE DATE OF <br />OCCUPANCY, <br />Section 2. All prior ordinances inconsistent with this <br />ordinance in whole or in part are repealed to the extent necessary to <br />avoid conflict with this orclinance. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that
