ORDINANCE N0. 87- 35 <br />INTRODUCED BYm Council President Santo Basile <br />AN ORDINANCE ENACTING CHAPTER 763 OF THE CODIFIED <br />ORDINANCES OF MAYFIELD VILLAGE, OHIO, PERTAINING <br />TO NOTIFICATION OF USE OF PESTICIDES. <br />WHEREAS, the commercial use of pesticides and pesticide <br />products on a particular property may cause a danger and hazard to the <br />surrounding properties and to the health and welfare of the occupants <br />thereon; and <br />WHEREAS, in view of such potential danger and hazard the <br />Mayor and Council of Niayfield Village, Ohio, have determined that the <br />residents of property abutting property that is treated with <br />pesticides are entitled to notification of such treatment; now, <br />thereforeP <br />BE IT ORDAINED BY THE COUNCIL OF MP,YFIELD VILLAGE, OHIO, THAT: <br />Section 1? There is hereby enacted Chapter 763 of the <br />Codified Ordinances of Mayfield Village, Ohio, which shall read as <br />follows: <br />Chapter 736 <br />Notification of Use of Pesticides <br />763.01 Definitions.. <br />For purposes of this Chaptera the words and phrases used <br />herein shall have the following meaning: <br />(a) "Pesticide" shall mean any substance or mixture of <br />substances intended for preventing, destroying, repelling <br />or mitigating any pest or any substance or mixture of <br />substances intended for use as a plant regulator, defoliant <br />or desiccant. <br />(b) "User of Pesticides" means any person who applies or <br />causes pesticides to be applied to property or the <br />atmosphere by any means where such person is engaged in <br />applying pesticides to trees, lawns, shrubs and plants. <br />(c) All other definitions in the Ohio Pesticide Law <br />as set forth in Chapter 921 of the Ohio Revised Code are <br />hereby incorporated herein as if fully rewritten. <br />763.02 Notice of Use of Pesticides. <br />All users of pesticides shall give notice to abutting <br />property owners of the application of pesticides to any property <br />within the municipality. The notice required herein shall be <br />in writing and must be left in a conspicuous place upon such <br />abutting properties at least twenty four (24) hours prior to
