RESOLUTION N0. 87-38 INTRODUCED BY: Mayor Carmen & Council as a Whole A RESOLUTION AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL TO EXECUTE AN ADDENDUM TO THE CONTRACT WITH COMMUNITY MUTUAL AND COMMUNITY LIFE FOR HEALTH AND TERM LIFE INSURANCE, RESPECTIVELY, FOR EMPLOYEES OF HAYFIELD VILLAGE, OHIO, FOR THE PERIOD COMPSENCING MARCH 1, 1987 AND TERMINATING FEBRUARY 29, 1988 AND DECLARING AN EMERGENCY. WHEREAS, the Council of Mayfield Village, Ohio, has ' previously adopted Resolution No. 87-16, authorizing the Mayor and President of Council to execute a contract with Community Mutual and Community Life for health and term life insurance, respectively, for employees of Mayfield Village, Ohio, for the period commencing March 1, 1987 and terminating February 29, 1988; and WHEREAS, the municipality has been advised that the carrier did not and cannot extend accidental death and dismemberment coverage to employees of the municipality if such instance occurs during the course of employment but will be covered under the said policy of insurance outside the course of employment; and WHEREAS, it is necessary to execute an addendum to the contract previously executed in order to effect the said change; now, therefore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: Section 1. The Mayor and President of Council are hereby authorized and directed to 'execute an addendum to the contract with Community Mutual and Community Life for health and term life insurance, respectively, through agent of record, Lawrence C. Barrett, C.L.U., DiBart Insurance Agency Corporation, for employees of the municipality for the period commencing March 1, 1987 and terminating February 29, 1988, a copy of said Addendum being attached hereto, marked Exhibit "A" and incorporated herein as if fully rewritten. Section 2. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. section 3. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village for the reason that the Addendum authorized to be executed herein is necessary to reflect the true terms and conditions of the policy of health and life insurance for municipal employees, an essential employee benefit.
