RESOLUTION N0. 87- 46 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION DECLARING EAGLE INTERNATIONAL TRUCK <br />SALES, INC., TO BE THE LOWEST AND BEST BIDDER FOR <br />THE SALE TO THE MUNICIPALITY -OF A TWO (2) TON <br />DIESEL POWERED CAB AND CHASSIS IN AN AMOUNT NOT <br />TO EXCEED THIRTY FIVE THOUSAND FOUR HUNDRED THIRTY <br />EIGHT DOLLARS ($35,438.00), AUTHORIZING THE MAYOR <br />AND PRESIDENT OF COUNCIL TO EXECUTE A PURCHASE <br />AGREEMENT FOR SAID EQUIPMENT, REJECTING ALL OTHER <br />BIDS RECEIV ED AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. In accordance with bids received pursuant to <br />advertisement as required by law, Eagle International Truck Sales, <br />Inc. is hereby declared to be the lowest and best bidder for the sale <br />to the municipality of a two (2) ton diesel powered cab and chassis. <br />Section 2. The Mayor and President of Council are hereby <br />authorized and directed to execute a purchase agreement with Eagle <br />International Truck Sales, inc. in an amount not to exceed Thirty Five <br />Thousand Four Hundred Thirty Eight Dollars (535,438.00) provided that <br />such purchase agreement is in accordance with the specifications upon <br />which the bid was received. <br />Section 3. All other bids received are hereby rejected. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the purchase made herein is necessary to maintain <br />effective governmental services. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than four <br />(4) members elected to Council and approval by the Mayor or otherwise <br />
