RESOLUTION N0. 87-51 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION DECLARING THE HORVITZ COMPANY TO BE <br />THE LOWEST AND BEST BIDDER FOR THE RESURFACING OF <br />CERTAIN STREETS WITHIN THE MUNICIPALITY, <br />AUTHORIZING THE MAYOR AND PRESIDENT OF COUNCIL TO <br />EXECUTE A CONTRACT WITH THE HORVITZ COMPANY IN AN <br />AMOUNT NOT TO EXCEED TWO HUNDRED SEVENTY SIX <br />THOUSAND NINE HUNDRED TWENTY FIVE DOLLARS <br />($276,925.00), REJECTING ALL OTHER BIDS RECEIVED <br />AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. In accordance with bids received pursuant to <br />advertisement as required by law, The Horvitz Company is hereby <br />declared to be the lowest and best bidder for the resurfacing of <br />certain streets within the municipality. <br />Section 2. The Mayor and President of Council are hereby <br />authorized and directed to execute a contract with The Horvitz Company <br />in an amount not to exceed Two Hundred Seventy Six Thousand Nine <br />Hundred Twenty Five Dollars ($276,925.00) for the aforesaid project <br />provided that said contract is in accordance with the specifications <br />upon which the bid was received. <br />Section 3. All other bids received are hereby rejected. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the contract authorized herein is necessary to <br />maintain an effective street repair program within the municipality to <br />provide for safe vehicular traffic. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than four <br />(4) members elected to Council and approval by the Mayor or otherwise <br />
