RESOLUTION N0. 87- 73 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION AUTHORIZING THE MAYOR AND PRESIDENT <br />OF COUNCIL TO EXECUTE AN AGREEMENT WITH THE <br />PROGRESSIVE CORPORATION PERTAINING TO THE <br />RELOCATION OF THE PROGRESSIVE CORPORATION DRIVEWAY <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Progressive Corporation has expressed its <br />desire to relocate its driveway so as to connect with a public street <br />exiting opposite Alpha Drive on Wilson Mills Road; and <br />WHEREAS, in order to assure the residents of the Worton Park <br />Area that such driveway relocation will not adversely affect the <br />residential area the municipality and the Progressive Corporation have <br />agreed to execute an Agreement to effect the protection of the Worton <br />Park residential area; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD V ILLAGE, OHIO, THAT: <br />Section 1. The Mayor and President of Council are hereby <br />authorized and directed to execute an agreement with the Progressive <br />Corporation in a form substantially similar to the one attached hereto <br />and marked Exhibit "A", provided the same is first approved by the <br />Director of Law and the Worton Park Homeowner's Association. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the action taken herein will facilitate a project that <br />will assist in alleviating the Wilson Mills traffic congestion. It <br />shall therefore take effect immediately upon passage by the affirma- <br />tive vote of not less than four (4) members elected to Council and <br />approval by the Mayor or otherwise at the earliest time allowed by <br />r, <br />
