RESOLUTION N0. 87- 75 INTRODUCED BY: Mayor Carmen & Council as a Whole r~ A RESOLUTION URGING THE OHIO GENERAL ASSEMBLY TO ENACT APPROPRIATE LEGISLATION PERTAINING TO AUTOMOBILE TAIL PIPE INSPECTION AND MAINTENANCE IN ORDER TO AVOID SANCTIONS IMPOSED BY THE FEDERAL GOVERNMENT. WHEREAS, the federal government has expressed its intent to impose sanctions against Cuyahoga County unless the State of Ohio enacts legislation to implement a tail pipe inspection and maintenance program; and WHEREAS, the sanctions would include the loss of approxi- mately Twenty Four Million Dollars (524,000,000.00) in federal highway funds; and WHEREAS, the loss of such funds would place additional burdens on state and local budgets; and WHEREAS, the United States Environmental Protection Agency has determined that legislation for a tail pipe testing program is necessary to ward off the implementation of sanctions; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio, have determined that the Ohio General Assembly should enact the appropriate legislation to prevent the imposition of sanctions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. The f9ayor and Council of Mayfield Village, Ohio, for themselves and on behalf of the employees and residents of Mayfield Village urge the Ohio General Assembly to enact legislation necessary to implement a tail pipe inspection and maintenance program in order to avoid the imposition of sanctions by the federal government. Section 2. The Clerk of Council is hereby authorized and directed to forward duplicate copies of this Resolution to Governor Richard F. Celeste and to the Cuyahoga County Delegation to the Ohio General Assembly. Section 3. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
