ORDINANCE N0. 88-1 <br />.INTRODUCED BYs Councilman David Petschauer <br />~ AN ORDINANCE ENACTING SECTION 505.11 OF THE <br />CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, <br />PERTAINING TO DANGEROUS AND VICIOUS DOGS, <br />REPEALING EXISTING SECTION 505.11 AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, enacted <br />Ordinance No. 84-11 on October 15, 1984 pertaining to vicious dogs; <br />and <br />WHEREAS, since the enactment of the aforementioned legisla- <br />tion the General Assembly of the State of Ohio enacted certain <br />legislation pertaining to dangerous and vicious dogs; and <br />WHEREAS, the Mayor and Council of Mayfield Village are <br />desirous of updating the existing legislation pertaining to such <br />animals in order to track the comparable State legislation; now, <br />therefore, <br />BE IT ORDAINED BY THE COUDICIL OF HAYFIELD VILLAGE, OHIO, THATt <br />Section 1. Section 505.11 of the Codified Ordinances of <br />Mayfield Village, Ohio, is hereby enacted to read as follows: <br />Chapter 505 <br />Animals and Fowl <br />* * ~ <br />505.11 Dangerous and Vicious Dogs. <br />(a) As used in this section: <br />(1) "Dangerous dog" is defined as follows: <br />A. "Dangerous dog" means a dog that, without provocation, <br />and subject to paragraph (a)(1)B, hereof, has chased or <br />approached in either a menancing fashion or an apparent <br />attitude of attack, or has attempted to bite or otherwise <br />endanger any person, while that dog is off the premises of <br />its owner, keeper or harborer and not under the reasonable <br />control of its owner, keeper, harborer or some other <br />responsible person, or not physically restrained or <br />confined in a locked pen which has a top, locked fenced <br />yard or other locked enclosure which has a top. <br />B. "Dangerous dog" does not include a police dog that has <br />chased or approached in either a menacing fashion or an <br />apparent attitude of attack, or has attempted to bite or <br />otherwise endanger, any person while the police dog is <br />being used to assist one or more law enforcement officers <br />in the performance of their official duties. <br />
