ORDINANCE N0. 88-1 .INTRODUCED BYs Councilman David Petschauer ~ AN ORDINANCE ENACTING SECTION 505.11 OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, PERTAINING TO DANGEROUS AND VICIOUS DOGS, REPEALING EXISTING SECTION 505.11 AND DECLARING AN EMERGENCY. WHEREAS, the Council of Mayfield Village, Ohio, enacted Ordinance No. 84-11 on October 15, 1984 pertaining to vicious dogs; and WHEREAS, since the enactment of the aforementioned legisla- tion the General Assembly of the State of Ohio enacted certain legislation pertaining to dangerous and vicious dogs; and WHEREAS, the Mayor and Council of Mayfield Village are desirous of updating the existing legislation pertaining to such animals in order to track the comparable State legislation; now, therefore, BE IT ORDAINED BY THE COUDICIL OF HAYFIELD VILLAGE, OHIO, THATt Section 1. Section 505.11 of the Codified Ordinances of Mayfield Village, Ohio, is hereby enacted to read as follows: Chapter 505 Animals and Fowl * * ~ 505.11 Dangerous and Vicious Dogs. (a) As used in this section: (1) "Dangerous dog" is defined as follows: A. "Dangerous dog" means a dog that, without provocation, and subject to paragraph (a)(1)B, hereof, has chased or approached in either a menancing fashion or an apparent attitude of attack, or has attempted to bite or otherwise endanger any person, while that dog is off the premises of its owner, keeper or harborer and not under the reasonable control of its owner, keeper, harborer or some other responsible person, or not physically restrained or confined in a locked pen which has a top, locked fenced yard or other locked enclosure which has a top. B. "Dangerous dog" does not include a police dog that has chased or approached in either a menacing fashion or an apparent attitude of attack, or has attempted to bite or otherwise endanger, any person while the police dog is being used to assist one or more law enforcement officers in the performance of their official duties.
