ORDINANCE N0. 88- 6 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />AN ORDINANCE ENACTING SECTIONS 763.03 AND 763.99 <br />OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, <br />OHIO, PERTAINING TO NOTIFICATION OF USE OF <br />PESTICIDES AND DECLARING AN EMERGENCY. <br />BE TT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. There is hereby enacted Sections 763.03 and <br />763.99 of the Codified Ordinances of Mayfield Village, Ohio, which <br />shall read as follows: <br />Chapter 736 <br />Notification of Use of Pesticides <br />* ~ <br />763.03 Enforcement. <br />The provisions of this Chapter shall be enforced <br />by the Building Commissioner or Building Inspector. <br />763.99 Penalty. <br />Whovever violates any of the provisions of this Chapter <br />shall be guilty of a misdemeanor of the first degree. <br />Section_2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3 This Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the enactment hereof provides for the enforcement of <br />an existing ordinance. It shall therefore take effect immediately upon <br />passage by the affirmative vote of not less than five (5) members <br />elected to Council and approval by the Mayor or otherwise at the <br />
