lst Amendment (05/16/88) ~, ORDINANCE N0. 88- 15 ' INTRODUCED BY: MAYOR CARMEN AND COUNCIL AS A WHOLE. AN ORDINANCE ENACTING NEW SECTION 513.01(dd) ENTITLED, "DEFINITIONS," AND AMENDING SECTION 513.045 ENTITLED, "POSSESSION, MANUFACTURE AND SALE OF DRUG PARAPHERNALIA," TO CHAPTER 513 "DRUG ABUSE CONTROL" OF PART FIVE "GENERAL OFFENSES CODE" OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO WHEREAS, the Mayor and Council have become aware of and are concerned with the general proliferation of "head shops" engaged in the sale of paraphernalia associated with drug use; and WHEREAS, the Mayor and Council find that such establishments serve only to entice young people to abuse substances which are known to be harmful and unsafe for human consumption; and WHEREAS, the Mayor and Council find that this situation has created a problem requiring legislation for the immediate preservation of the public safety and welfare. NOW, THEREFORE, BE IT ORDAINED by the Council of Mayfield Village, County i ~ of Cuyahoga and State of Ohio: ~ _~ '' SECTION 1: That new Section 513.01(dd) "Definitions°1 of Chapter 513 of Part Five of The Codified Ordinances of Mayfield Village, Ohio, be enacted to read as follows. 513.01 Definitions (dd)(1) "Drug Paraphernalia" means all equipment, products and materials of any kind which are used, intended for use, or designed for use, in planting, propagating, culti- vating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing., containing, concealing, injecting, ingesting, inhaling, or otherwise introducing into the Human body a controlled substance in violation of this Chapter. It includes, but is not limited to: (A) Kits use, intended for use, or designed for use in planting, propagating, cultivating, growing or harvesting of any species of plant which is a controlled substance or from which a controlled substance can be derived; ti
