113 ~ Theft and Fraud 545.07 <br />(1) Without the consent of the owner or person authorized to give consent; <br />(2) Beyond the' scope of the empress .or implied consent of the owner or person <br />authorized to give consent; <br />(3) By deception; <br />(4) By threat. ~ ' <br />(b) Whoever violates this section is guilty of petty theft, a misdemeanor of the first <br />degree, if the value of.the property or services stolen is less than three hundred dollars <br />($300.00), if the :property is not listed in Section 545.03 and if the offender has not previously <br />been convicted of a theft offense, (ORC 2913.02) <br />545.06 UNAUTHORIZED U5E OF A VEHICLE; VEHICLE TRESPASS. <br />(a) No person shall knowingly use or operate an aircraft, motor vehicle, motorcycle, <br />motorboat or other motor-propelled vehicle without the consent of the owner or person <br />authorized to give consent, <br />(b) This section does not apply to property removed from the State or if possession <br />is kept for more than forty-eight hours. <br />(c) The following are affirmative defenses to a charge under this section: <br />(1) At the time of the alleged offense, the actor, though mistaken, reasonably <br />believed that he was authorized to use or operate the propertyo <br />' (2) At the time of the alleged offense, the actor reasonably believed that the <br />owner ~ or person empowered to give consent would authorize the actor to <br />use or operate the property. . <br />(d) No person shall knowingly enter into or upon a motor vehicle, motorcycle or <br />other motor-propelled vehicle without the consent of the owner or person authorized to <br />give consent. <br />(e) Whoever violates subsection (a) hereof is guilty of unauthorized use of a vehicle, <br />a misdemeanor of the first degree, if the offender has not previously been convicted of a <br />violation of this section, Ohio R. C. 2913.03 or of any other theft offense. <br />(OR C 2913.03) <br />(f) Whoever violates subsection (d) hereof is guilty of vehicle trespass, a minor <br />misdemeanor. <br />545.07 ILLEGAL SALE OR POSSESSION OF MASTER VEHICLE KEYS. <br />(EDITOR'S NOTE: The provisions of former Section 545:07 are no longer <br />included in this chapter since the Ohio Legislature pursuant to Amended House <br />Bill 382 (effective March 19, 1987) increased the penalty to a fourth degree felony <br />thus necessitating that charges for the illegal sale or possession of motor vehicle <br />keys be filed under Ohio R.C. 4549.042.) <br />1988 Replacement <br />
