Ch. 1105 <br />Nonconforming defined -see P.Rz Z. 1113.17 <br />1149.01 ENFORCEMENT. <br />This Zoning Code shall be enforced by the Building Commissioner. <br />(Ord. 159. Passed 5-20-35. ) <br />11490 02 USE DISTRICT EXCEPTIONS. <br />(a) Except as otherwise provided in the Charter, the Planning and Zoning Commission <br />may in specific cases, after public notice and hearing, and subject to such conditions <br />and safeguards as the Commission may establish, determine and.vary the application <br />of the use district exceptions herein established, which permission shall be confirmed by <br />resolution of Council before becoming effective, in the following respects: <br />(1) Permit the extension of a nonconforming use of a building upon the lot <br />occupied by such use or building at the time of the passage of this Zoning <br />Code. <br />(2) Grant in undeveloped sections of the Municipality, temporary and condi- <br />tional permits but for not more than two year periods for structures and <br />uses that do not conform to the regulations herein prescribed for the use <br />district in which they are to be located. <br />(3) Permit the location of a Class U-5 use in a Local Business District <br />and permit the location of a Class U-6 use in any use district, provided <br />such use in such location will, in the judgment of the Planning and Zoning <br />Commission, substantially serve the public convenience and welfare and <br />will not substantially or permanently injure the appropriate use of the <br />neighboring property, and provided further that such permitted use is not <br />injurious, obnoxious or offensive by reason of emission of refuse water, <br />odors, dust, fumes, vibrations, smoke, gas, noise or otherwise, and <br />is not dangerous or harmful to life, health, property or morals, and will <br />not cause undue congestion on the public highways. <br />1988 Replacement <br />
