351.99 TRAFFIC CODE 92 <br />(d) This section shall not be applicable to those premises where less than fifty <br />total parking spaces are provided. <br />(e) (1) As used in this section, "handicapped person" means any person who has <br />lost the use of one or both legs, or one or both arms, who is blind, deaf <br />or so severely handicapped as to be unable to move about without the aid <br />of crutches or a wheelchair, or whose mobility is restricted by a permanent <br />cardiovascular, pulmonary or other handicapping condition. (ORC 4503.44) <br />(2) "Special handicapped license plates" and "parking card" mean any license <br />plates or parking card issued under Ohio R.C. 4503.44, and also mean any <br />substantially similar license plates or parking card issued by a state, <br />district, country or sovereignty with which the Ohio Director of Highway <br />Safety has entered into a reciprocity agreement as authorized by Ohio R.C. <br />5502.03, during the time the agreement is in effect. (ORC 4511.69) <br />(f) It shall be an affirmative defense to any offense charged .under subsection (c) <br />hereof that the party so charged is handicapped as defined in this section. <br />(g) The violation of any provision of this section shall be a misdemeanor of the <br />third degree. (Ord. 81-59. Passed 11-16-81.) <br />351.99 PENALTY. <br />(a) Whoever violates Section 351.03(d), (i), (q) or (s) shall be fined ten dollars <br />($10.00) if such fine is paid within forty-eight hours after such violation. <br />(b) Whoever violates Section 351.03(d), (i), (q). or (s) shall be fined twenty dollars <br />($20.00) if such fine is paid after forty-eight hours and before seventy-two hours after <br />such violation. <br />(c) Whoever violates any provision of Title Seven of.the Traffic Code for which no <br />other penalty is provided shall be fined three dollars ($3.00) if paid within forty-eight <br />hours after such violation. <br />(d) Whoever violates any provision of Title Seven of the Traffic Code for which no <br />other penalty is provided shall be fined five dollars ($5.00) if paid after forty-eight hours <br />and before seventy-two hours after such violation. <br />(e) Any person, firm or corporation charged with a violation of any provision of <br />this chapter for which payment of a prescribed fine may be made, may pay such sum in <br />the manner prescribed on the issued traffic ticket. Such payments shall be deemed a <br />plea of guilty, waiver of court appearance and acknowledgment of conviction of the alleged <br />offense and may be accepted in full satisfaction of the prescribed penalty for such alleged <br />violation. Payment of the prescribed fine need not be accepted when laws provide that a <br />certain number of such offenses shall require a court appearance. <br />(Ord. 76-16.
