ORDINANCE N0. 88- 27 INTRODUCED BY: Mrs. Mills, Mr. Rinker, and Mr. Petschauer AN ORDINANCE ENACTING SECTION 331.40 OF THE CODIFIED ORDINANCES OF HAYFIELD VILLAGE, OHIO, PERTAINING TO VEHICLES OPERATING ON A BIItE PATH AND DECLARING AN EMERGENCY WAS, Mayfield Village wishes to encourage the use of bike paths in the Village and to clarify the rights of bicyclists utilizing the bike path in the Village; and WHEREAS, the Mayor and Council have found it imperative to expressly prohibit the operation of vehicles other than bicycles on such bike paths for the safety of the bicyclists; now, therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Section 331.40 of the Codified Ordinances of Mayfield Village, Ohio, i~s hereby enacted to read as follows: 331.40 OPERATION OF VEHICLES ON BICYCLE PATHS (a) No person shall operate a vehicle upon any path set aside for the exclusive use of bicycles, when an appropriate sign giving notice of such use is posted on the path, except to cross it upon a permanent or duly authorized temporary driveway. (b) Such prohibition shall not apply to emergency or duly authorized vehicles. (c) Nothing in this Section shall be construed to affect any rule of the Director of Natural Resources governing the operation of motor vehicles, snowmobiles, all purpose vehicles; and bicycles on lands under his jurisdiction. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
