ORDINANCE N0. 88- 41 INTRODUCED BY: Mayor Carmen and the Entire Council AN ORDINANCE REQUIRIldG A TAP-IN CHARGE TO BE PAID FOR USE OF A WATER MAIN INSTALLED BY SAMUEL WELLMAN ALONG WILSON MILLS ROAD AND DECLARING AN EMERGENCY WHEREAS, Samuel Wellman, at his expense, will extend the water main from its existing point located at 7109 Wilson Mills Road (Permanent Parcel No. 831-26-15) to a distance of six hundred (600) feet Easterly to the front of his property at 7129 Wilson Mills Road (Permanent Parcel No. 831-27-5); and WHEREAS, the installation of said water main may be beneficial to the various properties adjacent in that connections may be made to said water main from said properties when needed or desired; and WHEREAS, Samuel Wellman is entitled to be compensated when connections are made to said water main to the extent of the benefits conferred upon adjacent properties in the amounts determined by the Village Engineer; now, therefore, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: SECTION 1. No property owner shall be issued a permit or be permitted to make a water main connection or tap-in from Wilson Mills Road to the water main installed by Samuel WelLnan (which starts at the previously existing water main in front of the property at 7109 Wilson Mills Road and extends Easterly approximately six hundred [600] feet), unless the property owner making such tap-in or connection first pays to said Samuel Wellman, his successors or assigns, the proportion of the cost of said water main as determined by the frontage of such property owner as compared to the total front footage of property abutting both sides of the six hundred (600) foot water main improvement plus six percent (6~) interest per annum from the date of installation. SECTION 2. No connection will be permitted to be made to said water main from any of said parcels until the owner or owners thereof give evidence to the Finance Director of Mayfield Village that Samuel Wellman, his successors or assigns, have been reimbursed in the amounts set forth in Section 1 as to any such parcel for which a connection is requested.
