Amended 3/15/89 <br />ORDINANCE N0. 89- 7 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />AN ORDINANCE <br />GRAN'PING A CONDITIONAL PAI2KI1dG VARIANCE <br />FOR THB PROPERTY KNOWN AS "VILLAGE PLAZA" <br />AND DECLARING AN ENERGENCY <br />WHEREAS, the Planning and Zoning Commission approved plans submitted for <br />property known as "Village Plaza" so that such occupancy would be consistent <br />with the permitted uses in a Local Business District, subject to the <br />limitation of one hundred fifty-one (151) parking spaces; and <br />WHEItFAS, such plans, as revised on November 12, 1987, included nine <br />thousand (9,000) square feet to be used as offices and five thousand eight <br />hundred twenty-five (5,825) to be used as retail sales; and <br />WHEREAS, since that time, the developer has leased four thousand three <br />hundred forty-five (4,345) square feet for offices and five thousand four <br />hundred forty-five (5,445) square feet for retail sales; and <br />WHEREAS, there remain four thousand six hundred fifty-fifty (4,655) <br />square feet for office use and three hundred eighty (380) square feet for <br />retail sales with only sixteen (16) parking spaces available for such use; and <br />WHEREAS, the developer has provided evidence of a good faith effort to <br />lease such space in accordance with the plans submitted on November 12, 1987; <br />and <br />WHSREAS, the developer has petitioned Council to use the remaining five <br />thousand thirty-five (5,035) square feet for retail sales because of his <br />inability to lease such space in accordance with the plans; and <br />WHEREAS, such use of retail sales would require a parking variance of <br />thirty-six (36) spaces; and <br />WHEREAS, the Mayor and Council have received a two (2) month study from <br />Sergeant John Jay, as the Traffic Officer, reporting that such variances would <br />not cause traffic and/or safety concerns for the adjacent business and patrons <br />thereof; and <br />WHEREAS, to avoid unreasonable hardship to the developer, Council desires <br />to grant a parking variance of thirty-six (36) spaces for the property known <br />as "Village Plaza," subject to the satisfaction of conditions stated by the <br />Law Director to the developer in a letter dated March 7, 1989, attached hereto <br />and incorporated herein; now therefore, <br />BE IT ORDAINLD BY THE COUNCIL OF MAYFIELD VII.LAGE, OHiO, THAT:
