T- <br />Note: Never received an original. <br />)U Gld <br />C <br />C 01 )Y <br />ORDINANCE N0. 89- .- <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING CHAPTER 1389 OF THE CODIFIED <br />ORDINANCES OF MAYFIELD VILLAGE ENTITLED <br />"REGULATED USES" <br />WHEREAS, Council of Mayfield Village desires to enact regulations per- <br />taining to certain business uses within the Village; and <br />WHEREAS, Council also desires to create equitable procedures for the <br />regulation of such uses. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. That Chapter 1389 of the Codified Ordinances of Mayfield <br />Village be enacted to read as follows: <br />"CHAPTER 1389 <br />REGULATED USES <br />1389.01 Purpose 1389.03 Location regulations <br />1389.02 Definitions 1389.04 Waiver provisions <br />1389.01 PURPOSE. <br />In the enactment, execution and enforcement of this title, it is recog- <br />nized that there are certain uses which, due to the nature of their operation, <br />are recognized as having seriously objectionable operational characteristics, <br />particularly when several of said uses are concentrated in close proximity to <br />each other thereby having a detrimental effect upon the surrounding area. The <br />regulation of these uses is necessary to insure the detrimental effects will <br />not contribute to the blighting, downgrading or other diminution of property <br />values of the surrounding neighborhood. The primary purpose of these regula- <br />tions is to prevent a concentration of these uses in any one (1) area. Uses <br />subject to these controls are: <br />(a) Adult Book store; <br />(b) Adult motion picture theater; <br />(c) Adult peep show; <br />(d) Massage establishment. <br />1389.02 DEFINITIONS. <br />(a) Adult Book Store.
