All private streets shall have a minimum <br />width of payment of twenty-four (24) feet. <br />(i) The Homeowners' Association shall control and maintain streets <br />and easements of access on nondedicated private streets. <br />Furthermore, deed restrictions shall be required in such cases <br />to include the following language: "The undersigned grantee(s) <br />hereby acknowledge(s) that he/she/they understand that the <br />premises described herein is located upon a nondedicated <br />street. Further, the grantee(s) understand that no governmen- <br />tal body is responsible for care and maintenance of such <br />private street. Should a private street ever become public, it <br />shall be reconstructed td public street standards prior to its <br />being accepted as a public street." <br />(j) All streets to be dedicated for public use shall conform with <br />the requirements for such streets in Chapter 1117 of the <br />Codified Ordinances where such chapter is not in direct con- <br />flict with this Chapter. <br />1159.06 CONSTRUCTION OF GOLF COURSE WITHIN A RECREATION AND RESIDENTIAL <br />DEVELOPMENT. <br />In order to insure that a golf course will be constructed within a <br />recreation and residential development and that, once constructed, the golf <br />course will be preserved as a golf course, the following regulations shall <br />apply: <br />(a) Guaranteein Construction of Golf Course. As a condition for <br />approval of a development plan pursuant to Section 1159.11, the <br />owner or developer of the R& R District shall execute a <br />completion guaranty ("completion guaranty") for the benefit of <br />the City, guaranteeing the completion of the golf course within <br />two (2) years folloFring.the issuance of the first building <br />permit within the R& R District. The completion guaranty <br />shall be secured in either of the following manners, at the <br />owner's election: <br />(1) By the delivery of a performance bond for the benefit <br />of the Village, in the amount of the anticipated <br />costs of constructing the golf course as determined <br />by the golf course architect and confirmed by the <br />Village Engineer ("completion cost"), issued by one <br />or more surety companies authorized to conduct <br />business within the State of Ohio, which bond shall <br />be in a form approved in writing by the Director of <br />Law; or
