09/19/89 ORDINANCE N0. 89-37 INTRODUCED BY: Mayor Carmen and the Entire Council AN ORDINANCE GR.ANTING A CONDITIONAL PARKING VARIANCE FOR THE PROPERTY KNOWN AS "WHEEZER'S RESTAURANT" AND DECLARING AN EMERGENCY WHEREAS, the owner of Wheezer's Restaurant requested approval of an outside dining area behind the main building consisting of approximately 720 square feet; and WHEREAS, the addition of such use would require a parking variance of eighteen (18) spaces on such property; and WHEREAS, to insure adequate parking for such use, Council would approve such variances on the condition that Wheezer's Restaurant provides additional parking for its employees and customers; and WHEREAS, the owners of Wheezer's Restaurant have affirmed that they have obtained permission from the adjacent property owner, to wit: Jefferson Park, to use their parking spaces after 5:00 P.M. daily; WHEREAS, to avoid unreasonable hardship, Council desires to grant a parking variance of eighteen (18) spaces for the property known as "Wheezer's Restaurant," subject to the conditions stated by the Law Director to the owners in a letter dated September 15, 1989, attached hereto and incorporated herein. BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. Council hereby grants a parking variance of eighteen (18) parking spaces for the property known as "Wheezer's Restaurant," located at 6535 Wilson Mills Road, Mayfield Village, Ohio, subject to satisfaction within ten (10) days of this date of the conditions stated by the Law Director to the owners in a letter dated September 15, 1989, attached hereto and incorporated herein. SECTION 2. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open
