09/14/89 <br />QRDINANCE N0. 89-38 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING SECTION 331.41 OF THE <br />CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, <br />PERTAINING TO VEHICLES OPERATING ON A BIKE TRAIL <br />REPEALING ORDINANCE N0. 88-27 AND ALL OTHER ORDINANCES <br />INCONSISTENT HEREWITH <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Mayfield Village wishes to encourage the use of bike trails in <br />the Village and to clarify the rights of bicyclists and pedestrians utilizing <br />the bike trail in the Village; and <br />WHEREAS, the Mayor and Council have found it imperative to expressly <br />prohibit the operation of vehicles other than bicycles on such bike trails <br />for the safety of the bicyclists and pedestrians; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILI.AGE, aIiIO, TIiAT: <br />SECTION 1. Section 331.41 of the Codified Ordinances of Mayfield Vil- <br />lage, Ohio, is hereby enacted to read as follows: <br />331.41 OPERATION OF VEHICLES ON BICYCLE TRAILS <br />(a) No person shall operate a vehicle upon any trail <br />set aside for the use of bicycles, when an <br />appropriate sign giving notice of such use is <br />posted on the path, except to cross it upon a <br />permanent or duly authorized temporary driveway. <br />(b) Such prohibition shall not apply to emergency or <br />duly authorized vehicles. <br />(c) Nothing in this Section shall be construed to <br />affect any rule of the Director of Natural Resourc- <br />es governing the operation of motor vehicles, <br />snowmobiles, all purpose vehicles; and bicycles on <br />lands under his jurisdiction. <br />SECTION 2. Ordinance No. 88-27 together with all prior Ordinances incon- <br />sistent with this Ordinance in whole or in part are repealed.
