Amended 11/20/39 **Ord. 89-42 was repealed by Ord. 90-7 <br />which was enacted 2/19/90. <br />ORDINANCE N0. 89-42 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />AMENDING SECTION 1181.03(c) OF THE <br />CODIFIED ORDINANCES OF MAYFIELD VILLAGE, OHIO, <br />PERTAINING TO THE LOT AREA PER FAMILY <br />IN A CLASS A-3 DISTRICT AND <br />REPEALING ALL ORDINANCES INCONSISTENT HEREWITH <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Existing Section 1181.03 entitled "Lot Area Per Family," of <br />the Codified Ordinances of Mayfield Village, Ohio, now consisting of Subsec- <br />tion (c) is hereby amended by increasing the lot area required for each <br />apartment suite in a Class A-3 District so that the new Section 1181.03(c) <br />will read as follows: <br />(c) In a Class A-3 District, no dwelling shall <br />be erected or altered to accommodate or make <br />provisions for more than one single-family <br />dwelling for each 20,000 square feet of the <br />area of the lot or for more than a two-family <br />dwelling for each 30,000 square feet of the area <br />of the lot, and no apartment house shall be erected <br />or altered to accommodate or make provisions for <br />more than one apartment suite for each 8,500 square <br />feet of the area of the lot. <br />SECTION 2. All prior Ordinances inconsistent with this Ordinance, in <br />whole or part, are hereby repealed to the extent necessary to avoid conflict <br />with this Ordinance. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. The Clerk of Council is hereby authorized and directed to <br />certify a copy of this Ordinance to the Cuyahoga County Board of Elections for <br />approval or rejection by the electorate of Mayfield Village, Ohio, pursuant to <br />Article III, Section 13, of the Charter of Mayfield Village, Ohio, and directs <br />the Clerk of Council and Law Director to take whatever other steps necessary <br />in order to comply with all directives of the said Board of Elections in order <br />to secure placement on the ballot as aforesaid.
