AMENDED 12/18/89 <br />ORDINANCE N0. 89-44 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW SECTION 514.14 <br />OF THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE <br />PERTAINING TO THE ALLOCATION OF FINES IMPOSED <br />FOR DRUG TRAFFICKING AND RELATED ACTIVITIES <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. New Section 514.14 of the Codified Ordinances is hereby <br />enacted to read as follows: <br />514.14 ALLOCATION OF FINES IMPOSED FOR DRUG TRAFFICKING <br />AND RELATED ACTIVITIES <br />(a) The Finance Director is hereby authorized and direct- <br />ed to establish a Special Revenue Generic Fund Type which <br />shall be known as the "Drug Law Enforcement Fund." Monies <br />from this fund shall be used to subsidize the Police <br />Department's efforts that pertain to drug offenses. <br />(b) Whenever the Police Department is primarily responsi- <br />ble for or involved in making the arrest of, and in <br />prosecuting, any offender in violation of Section 2925.03 <br />of the Revised Code, any mandatory fine imposed pursuant <br />to that Section shall be accounted for in the "Drug Law <br />Enforcement Fund." Any additional fine imposed pursuant <br />to division (I) of Section 2925.03 of the Revised Code <br />shall be disbursed as otherwise provided by law. <br />(c) Whenever a person is charged with any violation of <br />Section 2925.03 of the Revised Code and forfeits bail <br />posted pursuant to Sections 2937.22 and 2937.46 of the <br />Revise Code or Criminal Rule 46, the forfeited bail shall <br />be accounted for in the "Drug Law Enforcement Fund." <br />SECTION 2. The Director of Finance is further authorized and directed to <br />make application to the Management Advisory Services, of the Auditor of <br />State's Office for approval of the creation of the "Drug Law Enforcement <br />Fund." <br />SECTION 3. The Director of Finance shall make payment from said specific <br />fund upon receiving the proper certificates and vouchers or orders therefor by <br />proper Village officials authorized by law to approve same, or by Ordinance <br />or Resolution of Council to make expenditures, and provided that an
