11/03/$9 See amended copy <br />? <br />ORDINANCE N0. 89- 44 <br />BY: Mayor Carmen and Council as a Whole <br />AN ORDINANCE <br />ENACTING NEW SECTION 514.14 <br />THE CODIFIED ORDINANCES OF MAYFIELD VILLAGE <br />4TAINING TO THE ALLOCATION OF FINES IMPOSED <br />'OR DRUG TRAFFICKING AND RELATED ACTIVITIES <br />BE IT ORDAINED BY THE COU*IL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. New Section 51+.14 of the Codified Ordinances is hereby <br />enacted to read as follows: ? <br />514.14 ALLOCATION OF FINES IM SED FOR DRUG TR.AFFICKING <br />AND RELATED ACTIVITIES <br />(a) The Finance Director is hereby authorized and direct- <br />ed to establish a separate fund whic shall be know as the <br />Drug Offenses Trust Fund. Monies from this fund shall be <br />used to subsidize the Police Department efforts that <br />pertain to drug offenses. <br />•-' (b) Whenever the Police Department is prima ily respansi- <br />ble for or involved in making the arrest of, d in <br />prosecuting, any offender in violation of Secti n 2925.03 <br />of the Revised Code, any mandatory fine imposed ursuant <br />to that Section shall be paid to the Drug Offense Trust <br />Fund. Any additional fine imposed pursuant to di 'sion <br />(I) of Section 2925.03 of the Revised Code shall be <br />disbursed as otherwise provided by law. <br />(c) Whenever a person is charged with any violation of <br />Section 2925.03 of the Revised Code and forfeits bail <br />posted pursuant to Sections 2937.22 and 2937.46 of the <br />Revise Code or Criminal Rule 46, the forfeited bail shall <br />be paid to the Drug Offenses Trust Fund. <br />' SECTION 2. The Council finds and determines that all formal act'ons of <br />' this Council relating to the adoption of this Ordinance have been take at <br />; open meetings of this Council; and that deliberations of this Council a d of <br />i its committees, resulting in such formal action, took place in meetings en <br />? to the public, in compliance with all statutory requirements including the <br />? requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3.
