M.V. ORDINANCE N0. 89-49 <br />Page-2- <br />the area to be developed. The charges hereinabove provided shall <br />be placed into a fund entitled "Storm Drainage Capital Improvement <br />Fund" and shall be used only for the construction of off-site storm <br />drainage improvements within the Village, in accordance with the <br />Master Storm Drainage Plan adopted by Council and on file with the <br />Clerk of Council. <br />(c) Should the Village require a developer, upon the recommendation of <br />the Village Engineer, to reduce the developed storm water run-off <br />from his development to substantially increase the requirement set <br />forth in paragraph (a) hereof, in order to further reduce the peak <br />storm water discharge to the Village's drainage system, or to reduce <br />the number of retardation basins to be constructed and maintained <br />within the Village, or to combine the storm water storage require- <br />ments for two or more developments in one retardation basin to be <br />located at a more strategic or better site, the Village may enter <br />into an agreement, with the developer under the following <br />conditions: <br />(1) On any on-site or adjacent site retardation basin to be <br />constructed by such developer, the Village will set-off the <br />drainage charge as set forth in paragraph (b) hereof by an <br />amount equal to the estimated increased construction costs, <br />including the cost of extra land area to such developer for the <br />construction of the enlarged retardation basin which over and <br />above the estimated construction costs for the retardation <br />system as required under paragraph (a) hereof. The estimated <br />construction costs for both the retardation system required <br />under paragraph (a) hereof and this enlarged retardation basin <br />shall be determined by the Village Engineer and his <br />determination shall be final. <br />(2) The maximum set-off in the drainage charge as set forth in <br />paragraph (b) hereof shall not exceed on Two Thousand Dollars <br />($2,000.00) per acre of area to be developed. <br />(3) The developer shall either give the Village clear title to the <br />retardation basin site while reserving to himself the right to <br />use this area for recreation purposes, or grant the Village <br />an easement over such retardation basin site which gives the <br />Village the right to determine what other areas of the Village <br />may use this enlarged retardation basin to reduce the storm <br />water run-off from their proposed development. <br />(d) Should a developer request to use any excess or surplus water <br />storage capacity in a particular off-site retardation basin owned or <br />controlled by the Village as a substitution for all or part of the <br />water storage volume required to reduce the developed storm water <br />run-off from his development, as set forth in paragraph (a)
