ORDINANCE NO. 78-23 Page -3- <br />be placed in a separate and distinct fund which, together with the <br />interest collected on the same, shall be irrevocably pledged for the <br />payment of the principal and interest of said note or bonds in <br />anticipation of which it is issued, when and as the same fall due. <br />Section 9. It is hereby determined and recited that all <br />acts, conditions and things required to be done precedent to and in <br />the issuance of said note, in order to make the same a legal, valid <br />and binding obligation of the Village of Mayfield, have happened, <br />been done and performed in regular and due form and as required by <br />law; and that the amount of indebtedness to be incurred by the is- <br />suance of this note does not exceed any limitation of indebtedness <br />now fixed by law. <br />Section 10. The Clerk is hereby directed to forward a <br />certified copy of this ordinance to the County Auditor. <br />Section 11. It is hereby found and determined that all <br />formal actions of this Council concerning and relating to the adoption <br />of this ordinance were adopted in an open meeting of this Council, <br />and that all deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the public, <br />in compliance with all legal requirements includinq Section 121.22 of <br />the Ohio Revised Code. <br />Section 12. The Director of Finance is authorized to carry <br />into effect the terms of thYS ordinance immediately in order to avoid <br />costly lit3gation to the municipality and to take any steps which he <br />deems necessary to secure funds and turn them over to the order of <br />the Law Director for payment to Dolores Myotte and to her attorney <br />Earl Longley in settlement of the pending litigation. <br />Section 13. This is an emergency measure immediately neces- <br />sary for the preservation of the health, safety and welfare of the <br />residents of the municipality in that it provides for necessary flood <br />control and recreation.
