ORDINANCE N0. 78-35 gy; Mr. Grogan AN EMERGENCY ORDINANCE AMENDING SECTION 377.01 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF MAYFIELD VILLAGE TO COMPLY WITH THE OHIO RE- VISED CODE REGARDING PROTECTIVE HELMETS. WHEREAS, the Ohio legislature has enacted a law permitting persons, except those who are under the age of 18 years or are povice operators, to ride motorcycles or snow-mobiles without wearing protective helmets; and WHEREAS, it is incumbent upon each Municipality to conform its ordinances which relate to traffic, with the traffic laws con- tained in the Ohio Revised Code; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD VILLAGE OH2O THAT: Section 1. Section 377.01 (e) of the Codified Ordinances of the Village is hereby repealed. Section 2. That section shall be amended to read as follows: Section 377.01 (e) - No person shall op- erate or be a passenger on a snowmobile or motorcycle without using safety glasses or other protective eye device. No per- son who is under the age of 18 years, or who holds a Motorcycle Operators E ndorse- ment or license bearing a"novice" desig- nation that is currently in effect as provided in Section 4507.13 of the Re- vised Code of the State of Ohio, shall operate a motorcycle on a highway, or be a passenger on a motorcycle, unless wear- ing a protective helmet on his head, and no other person shall be a passenger on a motorcycle operated by such a person unlesssimilarly wearing a protective hel- met. The helmet, safety glasses, or other protective device shall conform with regulations prescribed and prQmulgated by the Director of Highway Safety. The provisions of this paragraph or a vio- lation thereof shall not be used in the trial of any Civil Action. Section 3. The remaining provisions of Section 377.01 of the Codified Ordinances of the Village shall remain in full force and effect.
