ORDINANCE N0. 78-35 <br />gy; Mr. Grogan <br />AN EMERGENCY ORDINANCE AMENDING SECTION 377.01 <br />OF THE CODIFIED ORDINANCES OF THE VILLAGE OF <br />MAYFIELD VILLAGE TO COMPLY WITH THE OHIO RE- <br />VISED CODE REGARDING PROTECTIVE HELMETS. <br />WHEREAS, the Ohio legislature has enacted a law permitting <br />persons, except those who are under the age of 18 years or are <br />povice operators, to ride motorcycles or snow-mobiles without wearing <br />protective helmets; and <br />WHEREAS, it is incumbent upon each Municipality to conform <br />its ordinances which relate to traffic, with the traffic laws con- <br />tained in the Ohio Revised Code; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD VILLAGE OH2O <br />THAT: <br />Section 1. Section 377.01 (e) of the Codified Ordinances <br />of the Village is hereby repealed. <br />Section 2. That section shall be amended to read as <br />follows: <br />Section 377.01 (e) - No person shall op- <br />erate or be a passenger on a snowmobile <br />or motorcycle without using safety glasses <br />or other protective eye device. No per- <br />son who is under the age of 18 years, or <br />who holds a Motorcycle Operators E ndorse- <br />ment or license bearing a"novice" desig- <br />nation that is currently in effect as <br />provided in Section 4507.13 of the Re- <br />vised Code of the State of Ohio, shall <br />operate a motorcycle on a highway, or be <br />a passenger on a motorcycle, unless wear- <br />ing a protective helmet on his head, and <br />no other person shall be a passenger on <br />a motorcycle operated by such a person <br />unlesssimilarly wearing a protective hel- <br />met. The helmet, safety glasses, or <br />other protective device shall conform <br />with regulations prescribed and prQmulgated <br />by the Director of Highway Safety. The <br />provisions of this paragraph or a vio- <br />lation thereof shall not be used in the <br />trial of any Civil Action. <br />Section 3. The remaining provisions of Section 377.01 <br />of the Codified Ordinances of the Village shall remain in full force <br />and effect.
