ORDINANCE N0. 78-37 BY: Mr. Bennett AN EMERGENCY ORDINANCE AWARDING A CONTRACT ON A NONCOMPETTTIVE BASIS TO ELLIOTT AND HUTCHINS, INC. FOR THE PURCHASE OF A SNOW BLOWER. WHEREAS, it has been determined that by this Council that it is desirable and necessary for purposes of protecting the public health and safety, particularly of school children, to purchase a snow blower for use during the 1978-1979 winter season; as WHEREAS, after careful search and evaluation by the Service Department with reports to Council, this Council deter- mines that the only unit available to adequately perform the function necessary in Mayfield Village is a municipal tractor unit manufactured by Trackless Vehicles, Ltd. of Courtland, Ontario, Canada; and . WHEREAS, it has been further determined by this Council that the "lead" time for delivery of these vehicles is such that by resorting to normal bidding procedures there will be no unit available to the Village for the 1978-79 winter season; and WHEREAS, Elliott & Hutchins, Inc. a Trackless Vehicles, Ltd. dealer in North Syracuse, New York, has a unit available for immediate delivery with no indication that a vehicle is available elsewhere for timely delivery on a bid basis; now, thereforE BE IT ORDAINED BY THE COUNCIL OF MAYFIEI,D VILLAGE, OHIO, THAT: Section 1. It is hereby determined by this Council that the award of a contract for a snow blower adequate to perform the functions necessary for Mayfield Village for the 1978-1979 winter season is declared to be noncompetitive for the reason that comprable adequate units are not available after dilligent search. Section 2. A contract for the purchase of a Municipal Tractor Trackless MT Series 222 Diesel Tractor with a two-auger, two-stage snow blower and a truck loading chute at a price of $23,895 is hereby awarded to Elliott & Hutchins, Inc., 706 Church Street, North Syracuse, New York 13212.
