Nothing herein shall <br />be construed as requiring the disclosure of any defense in- <br />formation or restricted data as defined in the Atomic Energy <br />Act of 1954 and the Energy Reorganization Act of 1974, as <br />amended. <br />747.04 ISSUANCE OF PERMIT <br />The Safety Director shall issue the Permit unless he has <br />reason to believe that the safety precautions involved are not <br />in accordance w3th Federal Regulations. <br />747.05 PENALTIES <br />Any person who violates any provision of this Chapter <br />shall be guilty of a misdemeanor of the first degree. <br />Section 2. This Ordinance is declared to be an emergency <br />measure necessary for the immediate preservation of the public <br />peace, safety, health, and welfare for the reason that the number <br />of shipments of radioactive materials is increasing, and that re- <br />cently there occurred an accident involving such a shipment in <br />the Northeastern Ohio area, and therefore it is necessary to take <br />immediate steps to protect the health, safety and welfare of the <br />residents of Mayfield Village; therefore, this Ordinance shall <br />take effect immediately upon passage by the affirmative vote of <br />not less than five (5) members elected to Council and approval <br />by the Mayor, or otherwise at the earliest time allowed by law. <br />President of Council <br />PASSED: October 16 1978 <br />APPROVED: _' - October 16, 1978 <br />_?,Robe t G. ebe, Mayor Date <br />ATTEST: <br />Clerk of Co cil <br />APPROVED AS TO FORM: <br />Guerin L.
