RESOLUTION NO. 78-58 <br />INTRODUCED BY: Mr. Flynn <br />A RESOLUTION OF INTENT TO APPROPRIATE FEE SIMPLE INTEREST <br />WHEREAS, the municipality finds itself in need of land <br />for the purpose of constructing a service garage and other municipal <br />buildings; and, <br />WHEREAS, the municipality already owns fee title to <br />Clear Acres Park and is desirous of extending and improving that <br />park area; and, <br />WHEREAS, the municipality has experienced increasing <br />flooding problems in the flood plain area and has chosen to rectify <br />this problem, in part, by allowing certain land areas to flood; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. This Council hereby deems it necessary and <br />declares its intention to appropriate fee simple interest in and <br />to the premises described in Exhibits "A","B" and "C", which are <br />attached hereto and made a part hereof, for the purpose of construction <br />of municipal buildings, expansion of existing park land and flood <br />control regulation. <br />Section 2. The Mayor is hereby authorized to cause written <br />notice of the passage of this Resolution to be given to the owners, <br />persons in possession or having an interest of record in the above- <br />described premises and said notice shall be served according to law <br />by a person designated for that purpose by the Mayor and to make <br />return of the service of notice in the manner provided by law. <br />Section 3.
