<br />ORDINANCE NO. 78-64 <br />INTRODUCED BY: Mr. Busa <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR <br />TO ENTER AN AGREEMENT WITH THE CUYAHOGA COUNTY <br />COMMISSIONERS FOR THE IMPROVEMENT OF THE INTER- <br />SECTION AT RIDGEBURY BOULEVARD AND LANDER ROAD. <br />WHEREAS, the County of Cuyahoga is considering improve- <br />ment of the intersection at Ridgebury Boulevard and Lander Road <br />by the addition of left turn lanes at all four (4) legs of the <br />intersection and other lanes as may be required; and <br />WHEREAS, the aforementioned intersection is located <br />within the municipal corporate limits of the City of Highland <br />Heights, the City of Mayfield Heights and the Village of Mayfield; <br />and <br />WHEREAS, the Cities of Highland Heights and Mayfield <br />Heights have previously'.enacted leqislation authorizing their <br />respective Mayors to enter into the aforementioned agreement with <br />the Cuyahoga County Commissioners; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, OHIO, THAT: <br />Section 1. It is declared to be in the public interest <br />that the consent of the Village of Mayfield, Ohio, be and such con- <br />sent is hereby given to the County of Cuyahoga to improve the above <br />described road, in accordance with plans, specifications and esti- <br />mates as approved by the County. <br />Section 2. The'-municipality hereby proposes to cooperate <br />with the County in the cost of.the above described improvement as <br />follows: <br />(a) By the, approval of an application for municipal coopera- <br />tion with the County in the cost of the improvement project to <br />the extent of funds received by an allocation from the County <br />Motor Vehicle $5.00 License Tax Fund. <br />, <br />(b) There sHall be no roadway participation by said munici- <br />pality for the aforesaid improvement other than $5.00 License <br />Tax Funds. <br />Section 3: Upon completion of said improvement the munici- <br />pality will thereafter keep said highway open to traffic at all times, <br />and <br />(a) Maintain the improvement in accordance with the provi- <br />sions of the statutes relating thereto and make ample financial <br />provisions for such maintenance;
