_ . i <br />i <br /> <br /> <br /> ? <br /> <br /> ?i <br />i? <br />I? <br />SIXTEENTH: That the MUNICIPALITY ayrees to deposit with the <br />Treasurer of Cuyahoga County, the MUNICIPALITY'S <br />share of the estimated cost of the project as set" <br />forth in the Eighth, Ninth and Tenth paragraphs of <br />this agreement, prior to an award of a contract for <br />the improvement; in the event the MUNICIPALITY fails <br />to make payment within ninety (90) days after being <br />invoiced, the COUNTY will charge interest on the <br />invoice amount at the rate of six percent (6%) per <br />year from the date of said invoice. <br />SEVENTEENTH: That in the event the MUNICIPALITY fails to make <br />payments provided for in the Eighth, Ninth and Tenth <br />paragraphs above and at the times stated in the <br />Sixteenth and Nineteenth paragraphs, the COUNTY may <br />certify the amount due from the MUNICIPALITY to the <br />County Auditor who shall and is hereby required and <br />directed to withhold from the next following semi- <br />• annual distribution to said MUNICIPALITY of taxes <br />levied and collected for general fund purposes a sum <br />equal to the amount so certified as due from the <br />MUNICIPALITY and that amount be forwarded to the <br />County Engineer for distribution to the appropriate <br />fund. <br />EIGHTEENTH: That the actual cost of the construction work described , <br />in the Eighth, Ninth and Tenth paragraphs of this <br />agreement shall be determined by field measurements <br />and unit contract prices. , <br />NINETEENTH: That if the cost as set forth above is greater than <br />the amount deposited by the MUNICIPALITY for the <br />items in the Eighth, Nintii and Tenth paragraphs, the <br />MUNICIPALITY shall, within thirty (30) days of the <br />receipt of a bill from the COUNTY pay the difference <br />between the amount deposited and the actual cost <br />chargeable to the MUNICIPALITY. <br />TWENTIETH: That upon completion of the improvement and the <br />payment of the final estimate, the COUNTY will <br />refund to the MUNICIPALITY the difference between <br />the amount deposited and the actual amount chargeable <br />to the MUNICIPALITY for items in the Eighth, Ninth <br />and Tenth paragraphs if this amount is less than the <br />amount deposited. <br />TWENTY-FIRST: That the MUNICPALITY shall prohibit pavement opening <br />in the pavement constructed under this contract, ' except for emergency or necessary repairs to existing <br />utility installations, for a period of five (5) <br />years after completion of.the project. <br />-5- <br />? <br />
