ORDINANCE NO. 79-3 <br />BY: .)Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR <br />AND DIRECTOR OF FINANCE TO ENTER INTO A <br />CONTRACT WITH FLOSSIE DIXON FOR THE PURCHASE <br />OF REAL PROPERTY. <br />WHEREAS, by previous Resolution, this Council declared <br />its intent to acquire approximately one acre of land at the rear <br />of property on SOM Center Road owned by one Flossie Dixon; and <br />WHEREAS, after negotiation, Flossie Dixon has indicated <br />a willingness to sell such property to the Village; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Finance Director are authorized, <br />empowered and directed to enter into a contract and consumate the <br />purchase of property being approximately one acre at the rear of <br />the property owned by Flossie Dixon on SOM Center Road in the <br />Village as is more fully described in Resolution 78-58, the same <br />being a declaration of intention to acquire such property. <br />Section 2. The purchase price shall be $8,500.00 and the <br />Village is authorized to pay all expenses normally incurred upon the <br />transfer of property. <br />Section 3. This is an emergency ordinance in that it <br />provides for the acquisition of property necessary for flood control <br />within the municipality. It shall therefore take effect immediately <br />upon passage by the affirmative vote of not less than five (5) <br />members elected to Council and approval by the Mayor or otherwise <br />at the earliest time allowed by law. <br />PASSED: <br />APPROVED: <br />APPROVED AS TO FORM: <br />Guerin L.
