Page -2- N0.79-17 (a) To maintasn the improvement in accordance with the provisions of the statutes relating thereto and to make necessary financial provisions for such maintenance; (b) To maintain the right-of-way and keep free of obstructions in a manner satisfactory to the County and to hold said right-of-way inviolate for public highway purposes, permitting no signs, posters, billboards, roadside stands or other private installations within the right-of-way limits except those necessary for traffic control and other uses of Wilson Mills Road as a roadway; (c) To prohibit parking within the limits of the roadway constructed under this ordinance within the corporate limits of Mayfield Village except to the degree that such will not interfere with adequate traffic flow; (d) To enact no rule or regulation restricting the use of the improved road by any class of vehicle or vehicle load otherwise permitted by the Ohio Revised Code to use a public highway. To the degree that the Codified Ordinances of Mayfield Village or other rules or regulations thereof con- flict with this provision, they are declared null and void. Sectson 5. Traffic control signals will not be installed on Wilson Mills Road without prior approval by the County and Mayfield Village will place and maintain all traffic control devices in con- formity with the Ohio Manual of Uniform Traffic Control Devices in compliance with the provis3ons of Section 4511.11 of the Ohio Revised Code and other related Sections thereof. Section 6(a) All existing street and public right-of-way within the municipality which ss necessary for the aforesaid improvement shall be made available therefor. (b) Traffic signalization upgrading, relocation of publicly- owned utilities or water line work made necessary by the improve- ment will be included in the project but Mayfield Village will cause to be made, at no expense to the County of Cuyahoga, all changes, alterations or repairs to all private or public utili- ties not made necessary by the improvement. (c) Construction, reconstruction and re-arrangements of both publicly and privately owned utilities in accordance with subsection 6(b) immediately above, shall be done in such a manner as not to interfere unduly with the operation of the contractor doing the repairinq and resurfacing of the roadway, and all backfilling of trenches made necessary by such utility arrangement shall be performed in accordance with the provisions of the Ohio Department of Transportation Construction and Material Specifications and shall be subject to approval by the County of Cuyahoga. Section 7. The contract form shall be that attached hereto and made a part hereof as Exhibit "A" or any form substantially similar thereto approved by the Director of Law.
