ORDINANCE NO. 79-20 INTRODUCED BY; Council as a Whole AN EMERGENCY ORDINANCE ADOPTING SEDTMENT' POLLUTION CONTROL REGULATIONS. WHEREAS, the rapid development of Mayfield Village and surrounding municipalities has increased and accelerated storm water run-offs; and WHEREAS, such increased storm water run-off has increased the incidents of flooding and has accelerated the process of stream channel erosion thereby increasing sediment pollution; and WHEREAS, a'successful program of erosion control and water management is necessary to preserve the integrity of the land within the municipality; now, therefore BE IT ORDAINED BY THE COUNCIL OF MAYFIEI;D VILLAGE, OH2O, THAT: Section 1. Section 1119.20 of the Codified Ordinances of Mayfield Villaqe, entitled "Sediment: Pollution Control Regulat'ions" is hereby enacted to read as follows: 1119.20 Sediment Pollution Control Regulations ` \ (a) No developer shall conduct any earth disturbing activities unles's the same are performed in accordance with the Sediment'. Pollution'Control Regul4tions which are on file at the Village Hall and available for inspection or copying, the same being incorporated herein as if totally rewritten. (b) Any developer who performs any earth disturbing activities in violation of these Regulations shall Por each and every violation or non-compliance be fined not more than $1,000.00. Each day during or on which-a violation continues shall constitute a separate offense. Section 2. This Ordinance is declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare in that it will provide for effective erosion control thereby preserving the lands within the municipality. This Ordinance shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval
