<br />ORDINANCE NO. 79-20 <br />INTRODUCED BY; Council as a Whole <br />AN EMERGENCY ORDINANCE ADOPTING SEDTMENT' <br />POLLUTION CONTROL REGULATIONS. <br />WHEREAS, the rapid development of Mayfield Village and <br />surrounding municipalities has increased and accelerated storm water <br />run-offs; and <br />WHEREAS, such increased storm water run-off has increased <br />the incidents of flooding and has accelerated the process of stream <br />channel erosion thereby increasing sediment pollution; and <br />WHEREAS, a'successful program of erosion control and water <br />management is necessary to preserve the integrity of the land within <br />the municipality; now, therefore <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIEI;D VILLAGE, OH2O, THAT: <br />Section 1. Section 1119.20 of the Codified Ordinances of <br />Mayfield Villaqe, entitled "Sediment: Pollution Control Regulat'ions" <br />is hereby enacted to read as follows: <br />1119.20 Sediment Pollution Control Regulations ` <br />\ <br />(a) No developer shall conduct any earth disturbing <br />activities unles's the same are performed in accordance with <br />the Sediment'. Pollution'Control Regul4tions which are on file <br />at the Village Hall and available for inspection or copying, <br />the same being incorporated herein as if totally rewritten. <br />(b) Any developer who performs any earth disturbing <br />activities in violation of these Regulations shall Por each <br />and every violation or non-compliance be fined not more than <br />$1,000.00. Each day during or on which-a violation continues <br />shall constitute a separate offense. <br />Section 2. This Ordinance is declared to be an emergency <br />measure necessary for the immediate preservation of the public health, <br />safety and welfare in that it will provide for effective erosion control <br />thereby preserving the lands within the municipality. This Ordinance <br />shall therefore take effect immediately upon passage by the affirmative <br />vote of not less than five (5) members elected to Council and approval
