<br />ORDINANCE N0. 79-38 <br />BY: Council as a Whole <br />AN EMERGENCY ORDINANCE RATIFYING THE <br />ACTIONS OF THE MAYOR AND DIRECTOR OF <br />FINANCE IN ENTERING INTO A CONTRACT <br />WITH JOSEPH A. PALERMO AND VIOLET L. <br />PALERMO FOR THE PURCHASE OF REAL <br />PROPERTY AND AN EASEMENT IN CONNECTION <br />THEREWITH. <br />WHEREAS, pursuant to Resolution 78-58 this Council declared <br />its intent to acquire approximately one acre of land at the rear of <br />property on S.O.M. Center Road owned by Joseph A. Palermo and Violet <br />L. Palermo; and <br />WHEREAS, after negotiation, the said Joseph A. Palermo and <br />Violet L. Palermo indicated a willingness to sell such property to <br />the Villaqe; and <br />WHEREAS, in negotiating the said purchase it was determined <br />that the municipality should, in addition to the purchase of the <br />subject property, purchase an easement running east and west over <br />the northe31127 feet of the front portion of that property owned by <br />Joseph A. Palermo and Violet L. Palermo on S.O.M. Center Road, and <br />WHEREAS, an agreement to purchase said property was reached <br />and, because of the necessity to immediately reduce said agreement to <br />writing in order to facilitate the construction of the new municipal <br />service building located to the rear of the subject property, said <br />agreement was reduced to writing and executed by the said Joseph A. <br />Palermo and Violet L. Palermo and by the Mayor and Finance Director <br />of the municipality in a form approved by the Director of Law; now, <br />therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The action of the Mayor and Finance Director <br />in executing an agreement to purchase approximately one acre of <br />property at the rear of the property owned by Joseph A. and Violet <br />L. Palermo on S.O.M. Center Road in the Village of Mayfield and an <br />easement running east and west over the northern 27 feet o£ the <br />front portion of that same property, all of which is more fully <br />described in the Contract of Sale which is attached hereto and is in <br />a form approved by the Director of Law, is hereby ratified in <br />accordance with the previous expression of intent to purchase said <br />property pursuant to Resolution 78-58. <br />Section 2. The purchase price for said property shall be <br />Eight Thousand Five Hundred Dollars ($8,500.00) for the purchase of <br />the rear portion of the property comprising approximately one acre <br />and Six Thousand Five Hundred Dollars ($6,500.00) for the purchase of <br />the easement running east and west over the northern 27 feet of the <br />front portion of the property.
